Dowry Demand-- Vague and Omnibus Allegations-- Absence of Specific Overt Acts or Dates in FIR Renders Prosecution for Dowry Harassment Legally Unsustainable

Vague and omnibus allegations, without attribution of specific acts, dates, or places, cannot sustain criminal proceedings under Section 498A of the IPC and Sections 3 and 4 of the Dowry Prohibition Act. A quarrel, by itself, does not constitute dowry harassment or domestic cruelty. Where allegations against multiple accused are identical in nature, courts must apply uniform standards; denial of parity to persons standing on identical footing is legally unsustainable. Benefit of quashing extended to a co-accused must equally extend to others against whom allegations are substantively the same.
