Domestic Violence -- Right of Daughter-in-Law in Shared Household -- Right to reside in shared household is not absolute and eviction is permissible in accordance with law
(i) Protection of Women from Domestic Violence Act, 2005, S.17 -- Domestic Violence -- Right of Daughter-in-Law in Shared Household -- Entitlement of a daughter-in-law to reside in a shared household does not confer an indefeasible right of continued residence. Dispossession remains permissible provided it is carried out in accordance with law. (ii) Civil Procedure Code, 1908, S.100 -- Eviction from Property -- Permissive Occupation by Son and Daughter-in-Law -- Occupation of property granted out of love and affection by an owner to his son and daughter-in-law confers no independent or co-ownership right. Continued residence cannot be claimed once the owner withdraws permission, in absence of proof of monetary contribution or co-ownership.
