Dishonour of Cheque -- Compounding at Appellate Stage -- Sanjabij Tari guidelines applicable even where complainant refuses to consent
Negotiable Instruments Act, 1881, S.138 -- Dishonour of Cheque -- Compounding at Appellate Stage -- The guidelines laid down by the Supreme Court in Sanjabij Tari v. Kishore S. Borcar for compounding of offences under Section 138 NI Act, including where a complainant refuses to consent, apply at every stage of litigation — trial, appellate, revisional, and before the Supreme Court. The reference to "the Magistrate" in paragraph 39 of Sanjabij Tari does not restrict the operation of those directions to the trial stage alone.
