Disclourse Statement--Police Custody--Statement Leading to Discovery Not Admissible Under Section 27 if Accused Not in Police Custody--Conviction for Murder Set Aside

Information leading to discovery of facts is admissible under Section 27 of the Indian Evidence Act only when given by a person in police custody at the time of making the statement. Absence of formal custody renders such evidence inadmissible under Section 27. While such information may be relevant as conduct under Section 8, it is weak evidence requiring corroboration and cannot sustain conviction independently.
