Disclourse Statement--Absence Of Elaborate Particulars In Disclosure Memorandum Does Not Invalidate Recovery Where Accused Himself Leads Police To Spot
Under Section 27 of the Indian Evidence Act, the essential requirement for admissibility of a discovery is that information supplied by the accused in custody must relate distinctly to the fact discovered — which includes both the object recovered and the knowledge of the accused as to the place of concealment. Absence of elaborate particulars in the disclosure memorandum does not invalidate a discovery where the accused himself leads police to the spot and produces the weapon. Testimony of chance witnesses on a public road cannot be rejected solely on grounds of their incidental presence, particularly where their accounts are consistent and corroborated by medical evidence.
