Defamation--Republication of Defamatory Content Already in Public Domain Attracts Criminal Liability Under Section 499 IPC

Section 499 IPC makes no distinction between first-time publication of defamatory content and redisplaying content already published on another platform. Prior existence of defamatory material in the public domain does not absolve criminal liability of a person who republishes it. Unless the act falls within the seven exceptions under Section 499 IPC, redisplaying derogatory content capable of harming the reputation of a person attracts the offence of defamation punishable under Section 500 IPC.
