Mere custody of cash at the instance of a spouse, without material establishing knowledge of its terrorist nexus or intention to further terrorist activities, is insufficient to attract offences under Sections 38 and 40 of the UAPA. Passive association or familial proximity to an accused does not constitute membership of or support to a proscribed organisation.
