Cruelty to Wife--Vague Allegations--Omnibus Allegations Without Specific Instances and Mere Matrimonial Unhappiness Do Not Constitute Cruelty Under Section 498A IPC
To establish an offence under Section 498A IPC, the prosecution must prove cruelty beyond reasonable doubt with specific instances of torture inflicted with intent to cause grave injury or drive the victim to suicide. Omnibus allegations by witnesses without specifying day, time, or year, and mere emotional distress or matrimonial unhappiness, do not satisfy the ingredients of Section 498A IPC. Unnatural death within seven years of marriage is insufficient for conviction if cruelty soon before death is not proved.
