Corruption-- Acquittal of Co-Accused in Conspiracy Charge Does Not Absolve Public Servant of Bribery
Acquittal of a co-accused or failure of a conspiracy charge under Section 120B of the IPC does not automatically result in acquittal of a public servant on the substantive charge under Section 7 of the Prevention of Corruption Act, 1988. The offence of demand and acceptance of bribe is independent of criminal conspiracy and can be proved against an accused individually, without establishing a meeting of minds with the co-accused.
