Co-operative Society--Recovery of Deposits--Consumer Protection Act 2019 Remedy Available Despite Mechanism Under Co-operative Societies Act, Section 100 Operates in Addition

Creditors of a co-operative society can recover deposited amounts by invoking the Consumer Protection Act, 2019, despite the existence of a separate recovery mechanism under the Kerala Co-operative Societies Act, 1969. Section 100 of the 2019 Act provides that its provisions are in addition to, and not in derogation of, any other law in force. The remedy available under the Co-operative Societies Act does not oust the jurisdiction of Consumer Forums. Being a special and later law enacted to protect consumers, the Consumer Protection Act overrides the Co-operative Societies Act on this aspect.
