Bail--Rape--False Promise of Marriage--Concealment of Subsisting Live-In Relationship with Another -- It Vitiates Consent Regardless of Its Legal Status--Bail Rejected
Under Section 69 of the Bharatiya Nyaya Sanhita, an accused cannot escape liability for false promise of marriage by claiming that his existing relationship with another woman was merely a live-in arrangement and not a legal marriage. Where material facts about a subsisting relationship are concealed from the prosecutrix, the nature of that relationship does not dilute the allegation of deception. Consent obtained by concealment of such facts remains vitiated, regardless of the formal status of the prior relationship.
