Narcotic Drugs and Psychotropic Substances Act, 1985, S.37 -- Bail -- NDPS Commercial Quantity -- Prolonged custody and delay in trial along with rehabilitation prospect warrant bail. Recovery of commercial quantity and criminal antecedents would ordinarily disentitle an accused to bail, but prolonged incarceration without examination of any prosecution witness, coupled with a genuine prospect of rehabilitation and settled family life, can justify grant of regular bail. Such rehabilitation circumstance has no bearing on the merits of the narcotics prosecution itself.
