Bail--Murder-- When Offence Is Serious in Nature, Proviso to Section 480 BNSS not to be invoked merely because Accused is female

The gender of an accused is not, by itself, sufficient ground for grant of bail under the proviso to Section 480 of the Bharatiya Nagarik Suraksha Sanhita, 2023, when the offence alleged is serious in nature. The benefit of the proviso available to women accused cannot be extended mechanically, irrespective of the gravity of the offence. Recovery of incriminating material from an accused constitutes reasonable ground to believe involvement in the offence, even where medical evidence does not fully corroborate one specific mode of assault alleged.
