Bail -- Absence of Informant -- Hearing of bail application not barred where informant informed but does not appear

(i) Bharatiya Nagarik Suraksha Sanhita, 2023, S.483(2) -- Bail -- Absence of Informant -- Presence of informant at hearing of bail application is not mandatory where the informant has been duly informed and chooses not to appear, since the informant may repose trust in the Public Prosecutor or A.G.A to oppose the application on her behalf, and the application can be heard in such absence. (ii) Protection of Children from Sexual Offences Rules, 2020, R.4 -- Bail -- Notice to Victim in POCSO Case -- The local police or SJPU must inform the victim and guardian of the schedule of bail proceedings, and the Court must ensure such information is given before deciding the bail application.
