Attempt to Murder-- Intention to Kill-- Single Blow Causing Grievous Injury Without Repeated Ferocity Does Not Attract Charge

Under Section 307 IPC, mens rea of a homicidal degree is a sine qua non (essential condition) for establishing attempt to murder--- Section 307 IPC criminalizes the attempt, not the consequence, and even grievous or life-threatening injuries do not automatically attract the provision unless the mental element demonstrably reflects a design to cause death. -- Prior enmity alone does not translate into homicidal intention unless it is of such acute intensity as to reasonably lead to an inference of intent to eliminate.
