Arrest -- Grounds of Arrest--Accused in Judicial Custody Need Not Be Separately Informed of Arrest Grounds on Production Warrant; Failure to Inform Relative Vitiates Arrest:
When an accused already in judicial custody is formally arrested in another case pursuant to a production warrant under Section 302 of the BNSS, separate communication of grounds of arrest to the accused is not mandatory. Form 37, which accompanies the production warrant, contains a specific direction to the officer-in-charge of the jail to inform the accused of the contents of the order and deliver a copy; this constitutes sufficient compliance. However, communication of grounds of arrest to a relative of the accused remains mandatory even in such cases, and failure to do so vitiates the arrest.
