Anticipatory Bail -- Cannot Be Made Conditional Upon Deposit of Any Amount; High Court Order Imposing Rs. 9 Lakh Payment Condition Set Aside
Grant of regular bail or anticipatory bail cannot be made subject to deposit of any amount. Where case for bail is made out, Court must grant it unconditionally; where not made out, Court may decline. Court cannot pass conditional order requiring deposit of particular amount as precondition for exercising discretion to grant bail. Such orders are impermissible and contrary to settled law.
