Anticipatory Bail--Bail Conditions--Live Location Sharing with Investigating Officer Cannot Be Imposed as a Condition of Bail
Directing an accused to keep mobile location active and share live location with the Investigating Officer is not a valid condition for grant of anticipatory bail. While courts possess wide discretion to impose reasonable conditions under bail orders, such conditions must not amount to continuous surveillance infringing upon personal liberty. Standard conditions such as executing a surety bond, attending trial, marking attendance before police, and refraining from threatening witnesses are permissible; however, live location sharing exceeds the permissible scope of bail conditions.
