AI-Generated Precedent -- Hallucinated Case Citations -- Decision based on fake AI-generated material is no decision in law

Insolvency and Bankruptcy Code, 2016, S.7 -- AI-Generated Precedent -- Hallucinated Case Citations -- A decision founded on non-existent, fake or hallucinated material generated through artificial intelligence and relied upon as precedent amounts to no decision in the eyes of law. Such a decision is vitiated even where the material has only an indirect bearing on the determination and must be set aside. Reliance on unverified AI-generated citations by an advocate constitutes misconduct, and reliance by a judge constitutes a serious lapse. Courts and tribunals must adopt a zero-tolerance approach towards production, citation or usage of such unverified material.
