Abetment Of Suicide -- Break-Up Of Relationship Alone Does Not Constitute Instigation -- Bail Granted
Mere breaking up of a relationship does not, by itself, constitute "instigation" under S.108 BNS/S.306 IPC. To establish abetment of suicide, there must be clear mens rea on the part of the accused, and the instigation must be of such a nature as to leave the deceased with no option but to take her own life.
